Please read these terms and conditions carefully before using Our Service.

Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

  • Application means the software program provided by the Company downloaded by You on any electronic device, named My Yard.
  • Company refers to My Yard.
  • Country refers to: Pennsylvania, United States.
  • Service Provider means any landscaper, lawn care professional, or contractor who creates an account and offers services through the Application.
  • Homeowner means any individual who uses the Application to discover, contact, or hire Service Providers.
  • Premium Subscription means the paid tier available to Service Providers that unlocks advanced features such as a dedicated business profile page, early access to job postings, and expanded service radius.
  • Terms and Conditions means these Terms and Conditions which govern Your access to and use of the Service and form the entire agreement between You and the Company.
  • You means the individual accessing or using the Service, or the company or legal entity on behalf of which such individual is accessing the Service.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement between You and the Company. By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part, then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Independent Contractor Relationship & Direct Contact

My Yard operates as an open directory and communications platform. We are not a landscaping provider, employer, or agent of any Service Provider listed on the platform. All Service Providers are independent contractors and are not employees, partners, or agents of My Yard.

Users are explicitly permitted to share contact details and connect directly off-platform. My Yard holds absolutely zero liability for property damage, personal injury, poor workmanship, payment disputes, or any other claims arising from interactions, agreements, or transactions between users and Service Providers.

My Yard does not mediate, arbitrate, or otherwise intervene in disputes between users. Any disagreement must be resolved directly between the parties involved.

Premium Subscription Tier & No-Refund Policy

Basic use of the Application is free for Homeowners. Service Providers may purchase a Premium Subscription to access enhanced features, including but not limited to a dedicated business profile page, early access to new job postings, an expanded service radius, and priority placement in search results.

Subscriptions are billed dynamically via our third-party payment processor (Stripe). By subscribing, You authorize recurring charges until cancellation. You may cancel Your subscription at any time through Your account settings; cancellation takes effect at the end of the current billing period.

If a user violates our community guidelines or these Terms and their account is suspended or terminated, they forfeit the remainder of their current billing cycle and will receive absolutely no refund. No refunds are provided for partial months or unused subscription periods.

User-Generated Content

Users retain ownership of the photos, text, descriptions, and other content they post to the Application, including yard pictures, reviews, direct messages, and public comments. By posting content, You grant My Yard a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content solely within the Application and related marketing materials.

Users are solely responsible for the content they publish. The following are strictly prohibited and subject to immediate account termination:

  • Harassment, hate speech, or threatening behavior directed at other users.
  • Spam, unsolicited commercial content, or misleading advertisements.
  • Offensive, obscene, or sexually explicit imagery.
  • Copyright infringement or unauthorized use of third-party intellectual property.
  • Fraudulent job postings, fake reviews, or deceptive business practices.

My Yard reserves the right to remove any content that violates these rules without prior notice.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company under any provision of these Terms and Your exclusive remedy shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. By continuing to access or use Our Service after revisions become effective, You agree to be bound by the revised terms.
